Welcome to Esperanza Sailing Club. These Terms & Conditions (“Terms”) govern your use of our website www.esperanzasailingclub.com (the “Site”) and participation in our sailing membership and charter services (the “Services”). By accessing our Site or booking a Service, you agree to these Terms.

1. Membership & Services

  • Esperanza Sailing Club is a brand owned and operated by Just Today LLC of Vieques, Puerto Rico.

  • Esperanza Sailing Club offers sailing memberships, day passes, and seasonal passes.

  • Membership benefits, sailing schedules, and inclusions are outlined on the Site.

  • Memberships are personal and non-transferable unless otherwise stated.

2. Booking & Payments

  • Bookings must be made through our Site or directly with our staff.

  • Payment is required at the time of booking unless other arrangements are approved.

  • We use Squarespace Commerce, Stripe for secure online payments, as well as PayPal, ATH Movil, and Venmo for payments in person.

3. Cancellations & Refunds

  • Day Passes: If you cancel at least 48 hours before the start of the scheduled sail you will be refunded the amount paid minus the 3% Processing Fee.

  • Season Passes / Memberships: Membership fees are non-refundable once the season begins. Prior to November 15th passes are refundable minus the 3% processing fee.

  • Esperanza Sailing Club reserves the right to cancel or reschedule trips due to weather, safety, or operational issues.

  • Unused or cancelled sailing days do not roll over to future weeks.

  • If weather conditions are above sailing limits then the charter will automatically change to the “Harbor Hangout” or “Sunset at Anchor”, and billed at that rate.

4. Safety & Conduct

  • All passengers must follow the captain’s instructions at all times.

  • Life jackets are provided and must be worn if instructed.

  • Alcohol is permitted in moderation; unsafe or disruptive behavior will not be tolerated.

  • Esperanza Sailing Club reserves the right to refuse service to anyone for safety reasons.

5. Assumption of Risk & Liability

  • Sailing involves inherent risks, including but not limited to weather changes, seasickness, and physical activity on board.

  • By booking a Service, you acknowledge and accept these risks.

  • Esperanza Sailing Club, its owners, and crew are not liable for personal injury, property loss, or damages unless caused by gross negligence or willful misconduct.

  • Passengers must disclose any medical conditions that could affect their ability to safely participate.

6. Use of Website

  • You agree not to misuse our Site or attempt to interfere with its operation.

  • All content on the Site (text, images, logos) is property of Esperanza Sailing Club and may not be copied without permission.

7. Privacy

  • We collect and use personal information as described in our Privacy Policy.

  • By using our Site, you consent to such collection and use.

8. Changes to Terms

  • We may update these Terms from time to time. Any changes will be posted on this page with the updated Effective Date.

9. Severability

  • If any provision of these Terms is found to be invalid, illegal, or unenforceable for any reason, the remaining provisions shall remain in full force and effect.

10. Governing Law

  • These Terms are governed by the laws of the Commonwealth of Puerto Rico.
